Practice Pointer from the Vermont Service Center on O1

Jul 29, 2009

AILA InfoNet Doc. No. 09072962 (posted Jul. 29, 2009) The American Immigration Lawyers Association's USCIS Vermont Service Center Committee has given the following points on filing an O-1 petition for alien's of extraordinary ability. The O-1 visa is for aliens of extraordinary ability in arts, atheltics, business and science.

Once you have ascertained which labor union is appropriate, submit the following:

1.A cover letter with your contact information:

2.A copy of the I-129 Form and O supplement;

3.A copy of the contract or summary of the agreement under which the beneficiary will be employed;

4.A copy of the beneficiary's itinerary;

5.A copy of the employer support letter, outlining eligibility for the O-1;

6.A smattering of support materials to establish that the beneficiary is eligible for the O-1;

7.Filing fee check. It is advisable to phone the union to confirm the current charge. Some unions have expedited service (48 hour turnaround) available for an additional charge.

Submitting the above by overnight mail is the best way to get a timely consultation. Labor union consultations are valid for two years and may be reused for other petitions during that period.
