The USCIS announced that it will reopen the fiscal year 2009 H-2B petition filing period and will immediately accept new H-2B petitions. On January 7, 2009, USCIS previously announced it accepted and approved sufficient number of H-2B petitions to meet the cap of 66,000. However, the Department of State received far fewer than expected requests for H-2B visas and as a result has only issued 40,640 H-2B visas. All visas must be issued by September 30, 2009 so it is recommended that any new filings are accompanied by a premium processing request for expedited service.
