The USCIS announced on August 18 that it will add premium processing service to two I-140 categories (EB3 Professionals and EB3 Skilled Workers). This is the first time that premium processing service will be open to the I-140 form, which is the Immigrant Petition for Alien Worker. Under premium processing, the government charges a fee of $1000 to look at a case within 15 calendar days. Once it looks at the case, the USCIS will either approve it, deny it or request additional evidence. If additional evidence is requested, the clock is stopped and then resumed again once the required evidence is submitted.
The EB3 professional category is for immigrant workers with bachelor's degrees who are members of the professions. The EB3 skilled worker category is for individuals who are being sponsored for skilled labor positions requiring at least 2 years of education, training or experience. Premium processing is not available for the EB3 "other worker" category for unskilled workers.
This premium processing service will start on August 28, 2006. A new premium processing form, Form I-907, must accompany the premium processing request. Up until August 28, you can use the current version of the form with the revision date of 4/1/2006.
