As many of you already know, the July visa bulletin issued by the U.S. Department of State in mid-June 2007 showed that all of the employment based visa numbers were current. This meant that many people who had been waiting for a long time to file their I-485 applications could file in the month of July. However, on July 2, 2007 the first day of filing for the month of July, the USCIS announced that it would reject any I-485 applications. The State Department also provided an update to the visa bulletin. A class action law suit is being prepared by the American Immigration Law Foundation. If you have filed an I-485 application on or about July 2, 2007, and are expecting it to be returned by the USCIS, then you should be considered a class action plaintiff. It is our law firm's suggestion that you continue to file your I-485 application through the month of July. However, should you decide to file, there is a strong possibility that your I-485 application will not be returned to you for many weeks.
